French Schneider Electric is one of the joint venture partners of Tianjin Merlin Gerin Co., ltd. the Trademark "MERLIN GERIN" has been used in France since 1930, and it was registered in France in 1968. In 1999, Schneider Electric registered this trademark before Chinese Trademark Office and obtained approval in 2003. In 1987, this corporation signed an agreement with Tianjin Merlin Gerin Co., ltd. to allow the use of the trademark.
Founded in 1999, Shanghai MGE was is an enterprise manufacturing, processing low-voltage electrical appliances, switch cabinets, control boxes, and it uses the registered trademark “MERLIN GERIN” on its circuit breaker products. Recently, Shanghai MGE was sued before court by Tianjin Merlin Gerin Co. Ltd. and its foreign joint venture partner, Schneider Electric (China) Investment Co., Ltd.
A few days ago, the first-instance court ruled Shanghai MGE to change its company name, to stop using its website domain name and general website address, to stop unfair competition behavior of false propaganda, and to compensate CNY 0.5 million as economic loss to the plaintiff, Tianjin Merlin Gerin Co., Itd. The second instance court made final decision to uphold the original ruling.
